Izumi, you should look up the tenancy act for your province/state.
Unless you REALLY trashed the place and he has photographic evidence to prove it, there is no reason he should charge you more than your damage deposit.

He doesn't. He said that even in the picture the carpet looked fine.

I'm just wondering what we can do, because everything I'm reading so far doesn't sound too promising. (I live in Michigan BTW) Apparently he has 30 days in which to write us of any damages, unless we don't provide a forwarding address. Well Aaron didn't give him our address, and apparently it's suppose to be given to the landlord 4 days after the termination of occupancy. Well nothing was in writing...we called the landlord, told them the date we were moving and turned the keys in mid August. Paid him half the month's rent (although he wanted the full month's), but didn't even think twice for pursuing our deposit.
It says even if we do fail to notify the landlord within the 4 days time, we don't forfeit our write to the deposit. So I guess that could be taken into consideration. He could show that the carpet was replaced, but could he really prove to the judge that it needed to be replaced in the first place? He himself said that he took photographs of the apartment, but that it *looked* just fine in the photo, but claims it smelled bad. I remember leaving that place and there wasn't any.
He probably gives smokers this hard of a time too...Ugh.

Izumi, I doubt he will actually take you to court over this because the evidence against you is non-sufficient. A judge cannot tell from a photograph how the carpet smells, and therefore can't give judgement one way or the other. I think maybe he's pissed at you because he wanted a full months rent out of you. He's just scorned.

Oooh! Naps!! Naps are almost as awesome as bacon.
Well, I have moved the remaining bacon from the freezer to the fridge, but it might have to wait until tomorrows dinner... I am going to a friends place for dinner in a couple hours and it would be kind of rude if my tummy was so full of delicious bacons that I couldn't eat her meal....
but oh lawd, am I ever tempted...

Pretty good! Its my day off. Tomorrow I thrust myself head-first into another crazy-ass work week.... my last week at the store before I transfer again.... it should be all sorts of crazy and stressful! So, I am seizing the day! Downloading some Wonder Years torrents and sippin on a pepsi. I'm thinking I should probably shower soon... its been one of those lazy mondays :)

I'm hoping you're right Hollywood. My parents seem to think he's got little to stand on as well. I went over to my friend's house here and her husband seems to think he can actually take a sample of the carpet to the judge, but at the same token he can't really prove that it was us who did it as he hasn't any evidence in the picture to prove there was a problem.
Just got a text from Aaron's friend who had the wedding. He wants us to help him finish off the keg from the party. Apparently there's half a keg left and 4 of us. I think tonight would be a good night to have a get together and possibly crash on his couch. If not, I might stay sober and drive us home. I'm not big on drinking, but I could use to get the hell out of here.

Ohhh dude.... drain the keg. If ever there was a good day to let loose and relax, it's today.
I'm not a big beer drinker myself, but on a bad day, anything works. I prefer herbal methods to relax, but when push comes to shove a beer or two never hurt anyone.

I'm probably going to have to push hubby to go though. He's never very motivated after work. I can't blame him though as 12 hour shifts are brutal. He doesn't have work tomorrow though and I'm sure he could use a bit of social time as much as I do. Otherwise we can sit around and mope and shit.
That and I really want to patch stuff up with his friend and wife. I kinda left early at the wedding and felt bad...and if anything I could use to make more friends, not lose them.

Awww why did you leave the wedding early?
I think you should go! They obviously care about you guys if they want you to come drain the keg with them, so all will be well! I think it would be a nice release!
And yes, 12 hours shifts ARE brutal but sometimes you just have to say "fuck it" and go and have a good time. Play hard, then sleep hard!

Well we went. Brought a couple of hot n ready little ceasar's pizzas and looked through wedding photos. Also, his wife finally sent what photos they had of our wedding back in June.
His wife was pretty well lit when we got there though, and like the three of us were pretty much sober the entire time. Hubby and I only had one glass a piece and that was enough. As I said, hubby is tired and wanted to go to sleep in his own bed so it wasn't too terribly 'exciting' but it was nice to see them.
