okay, put your lawyer caps on and tell me what you think:
I had my tub repaired probably 2 years ago.
recently the wall between my closet and front room has been weeping water from the upstairs tub overflow down through that wall into the subfloor and bringing up nasty nastyness into my front room carpet.
obviously this took a while for the walls and such to become saturated enough from little bits of tub overflow for this to happen.
management is coming out on Friday to recaulk around the tub base.
apparently if the wall and floor have to be replaced it's my fault because it was my kid splashing in the tub.
but wouldn't it also be management's fault for not properly caulking around the base of the tub to begin with?

@crazy: Unless they can PROVE your kid started the whole thing, then I would think it's management's problem. I mean, it's a bathroom, it should have proper caulking around the entire tub, enough to handle a bit of splashing.
