At first I didn't think they were, but after watching a certain video, and seeing stunning similarities, To me, The ex- evanescence band members are just trying to get the attention they had, when they had Amy.
Like two of the points in the movie, the guitar writes are surprisingly similar, and We are the fallen, is often preforming Evanescence song covers.
Two questions ;
Is We are the fallen trying to be an new, better even evanescence, and will they succeed? Or will they fail miserably, and admit that they're ripping off EV?
Well since the band does have former members in it, yeah it's going to have similarities. You don't just change you're art style just because you're not performing with someone any more. Sometimes there are members that want to try something different and others don't agree. I've seen it tear bands apart more than a few times. Sometimes it's fun to do covers of songs that were in your other bands if fans already know the songs. That way you get people singing along when they may not know your new material yet. Since fans of We are the Fallen would know some EV stuff I don't see a big deal of playing it live. It's just like Angels and Airwaves playing Blink-182 songs live.
The media can make anything sound better or worse than what it really is so I wouldn't go by what a video says. You can make anything sound the way you want it to and post it on a video. Internet rumors aren't really the best places to go for "sources" on what happens inside of bands.
For the record, I am not a fan of We are the Fallen. I do quite enjoy OLD EV though. New stuff I don't care for all too much even though I do agree that Amy has more singing power than Carly will ever have.
I pretty much agree with all of Mystic's post. Yeah, the bands are going to have similar material because they WROTE it all anyway. As far as why so and so left and joined WATF or however it went down, everything said in the video was pure speculation and essentially no more proof than anything you'd read in a gossip mag.
WATF does seem to NOT dislike the idea of being similar to Evanescence despite what they say, however. They didn't make Carly dye her hair black but they did choose her, out of any other potential candidate, to be the lead singer and IMO, that says more than their words do.

Honestly, only really like one of We Are The Fallen's songs enough to listen to it over and over, and it does bare a resemblence to Evanescence. But, as it has already been pointed out, WATF has former members of Evanescence, so similarities are going to happen.
Are they an actual rip off of Evanescence, I think not. For one, the lyrics are about different experiences because EV deals with stuff Amy Lee goes through while WATF deals with Ben Moody and Co's issues if I'm not mistaken. If I am, feel free to correct me. As noted above, I'm not a OMG-LOVE fan of either We Are the Fallen or Evanescence.
Evanescence has also started to take a bit different musical direction as of late than We Are The Fallen. If anything, WATF is continuing in the vein of the older Evanescence sound, where Amy is going her own way (which seems to be more electronic based than rock based from snippets that I've heard) with Evanescence.
At the current moment, they're two different style bands, so I disagree with the "copycat" position. :)
Ahhhhhhhhh! Hardcore Evanescence fan here. Amy Lee is the reason I like Evanescence, so without her, this new wannabe Evanescence band is never going to compare with Evanescence. They really are just better off not trying to compare. It's like comparing apples to oranges. They are pretty awesome sounding, but I much prefer Evanescence. There styles are similar, but I think I'd look past the similarities and see the differences. By just dwelling on the similarities and trying to figure out if they're just a rip-off, you'll just fill up with negative attitudes. It's always better to see things on the positive side. Just accept them as a new band that is trying to express their love for a specific style of music.
Okay, I changed my mind. I actually really like these guys. Their lyrics are going on me. And her voice is pretty sick. Not sure I'd say they are a rip-off Evanescence. Like I said before, I think they're just their own unique band. They do have their differences.
I like to think of We are the Fallen and Evanescence as two separate bands. Ev now has this... fairy-tale style, in a sense, that has this dark seductive sound, while WATF has more of the Old-EV dark rocky/metal sound.
