Sort of. I was being emotional support to my then wife (now exwife), when her mother passed away in a hospital. The lawsuit was for malpractice, as there were multiple signs of improper medical procedure. I never learned the results however as my exwife went crazy a few months later...

But I just wanted to share something funny. My mom once sued my dad (while they were married) because she claimed he was driving really poorly and she was injured... [lol] She said, "Nothing personal, hubby..." |

How do you sue your spouse? Considering a married couple's belongings are usually combined.

It depends if there were any declarations of trust made and also on the other's finanaces as the debtor has to pay their debts before any funds can go to them. And then there's proving that there was intent that it was bought for both not purely as a gift for the other.
I'm in the conveyancing department and as we're a small office we all cover reception so we end up hearing everything. |
Geeze... so glad I will never experience that, though my exwife stole a lot of my stuff I managed to get most of it all back without trouble.

It's very much on a case by case basis. Some can be six months others can take years.
Somtimes it can be pretty straight forward other times it's really complicated especially if the ex-parter has disapeared. |

If they disapear and they've not instructed their own solicitor then it involves hiring an investigator to track them down and they are found and paid cash in hand there's not much than can be done as they're not on any payrolls so you can't prove it's them.

With regard to the property of married couples, it really depends on how the property was used. If each person has a separate account, but uses the money to pay for shared things, the money would be considered shared and vice-versa. It may also take into account when the property was procured (i.e. before or after the marriage), so not all property is marital.
Legal systems of countries is very interesting, but also remarkably complex in how it addresses new circumstances in society. As to whether I've ever been involved personally in a lawsuit, that would be a no. I've been in arbitration before, which is usually when a retired judge acts as a mediator between you and the other party. You come to an agreement, and it's legally binding. |
