Ok Insomniac. I haven't had time for you today but now that I do You can see how I am only saying what I am to save you future legal trouble. I may not like you and you may not like me but I love this community and I'll do what I can to keep it standing. Feel free to disregard me completely as is your right although I don't suggest it.


The first legal issue with the new privacy policy was that there was a clash of sections. Seeing as you won't trust by word, I'll cite congressional statutes as well as court cases to give my argument validity.

Here is a quote from the CAN-SPAM act.
(I have omitted any irrelevant sections for readability)

CAN-SPAM Act of 2003

15 U.S.C. §§7704

§ 7704. Other protections for users of commercial electronic mail

(A) Omitted

(B) Aggravated violations relating to commercial electronic mail

(1) Address harvesting and dictionary attacks –

(A) In general

It is unlawful for any person to initiate the transmission, to a protected computer, of a commercial electronic mail message that is unlawful under subsection (a) of this section, or to assist in the origination of such message through’ the provision or selection of addresses to which the message will be transmitted, if such person had actual knowledge, or knowledge fairly implied on the basis of objective circumstances, that –

(i) the electronic mail address of the recipient was obtained using an automated means from an Internet website or proprietary online service operated by another person, and such website or online service included, at the time the address was obtained, a notice stating that the operator of such website or online service will not give, sell, or otherwise transfer addresses maintained by such website or online service to any other party for the purposes of initiating, or enabling others to initiate, electronic mail messages; or

(ii) Omitted

Now the gap that you will note is between Menewsha Privacy policy Sections 2.2 and 3.1

3.1 Sale or Transfer to Third Parties.
MENEWSHA.COM MAY SELL OR TRANSFER INDIVIDUAL INFORMATION TO THIRD PARTIES FOR ANY LEGALLY PERMISSIBLE PURPOSE IN MENEWSHA.COM’S SOLE DISCRETION.

2.2 Email.

Menewsha.com uses Individual Information to provide promotional offers by email to individuals. Menewsha.com may maintain separate email lists for different purposes. If email recipients wish to end their email subscription from a particular list, they need to follow the instructions at the end of each email message to unsubscribe from the particular list. To unsubscribe from all Menewsha.com’s email lists, a person must send an email to [email protected]. 2.2(a) Content of Email Messages. In certain commercial email messages sent by Menewsha.com, an advertiser's name will appear in the “From:” line but hitting the “Reply” button will cause a reply email to be sent to Menewsha.com. The “Subject:” line of Menewsha.com email messages will usually contain a line provided from the advertiser to Menewsha.com. 2.2(b) Solicited Email. Menewsha.com only sends email to individuals who have agreed on the Website to receive email from Menewsha.com or to individuals who have agreed on Third Party websites to receive email from Third Parties such as Menewsha.com. Menewsha.com does not send unsolicited email messages. As a result, statutes requiring certain formatting for unsolicited email are not applicable to Menewsha.com’s email messages.

In section 3.1 you state that you have the ability to sell a user's information to third parties which would seem to make you immune to CAN-SPAM§7704(B)(1)(A)(i) by means of:

".....and such website or online service included, at the time the address was obtained, a notice stating that the operator of such website or online service will not give, sell, or otherwise transfer addresses maintained....."

But then you completely throw that out at the end of 2.2.

".........Menewsha.com does not send unsolicited email messages. As a result, statutes requiring certain formatting for unsolicited email are not applicable to Menewsha.com’s email messages."

By stating that, if you were to sell any information to a third party and in turn that third party were to send an unsolicited e-mail, Menewsha.com would be in direct violation of its own policies and CAN-SPAM§7704(B)(1)(A)(i) as you do not state this in section 3.1:

".....to any other party for the purposes of initiating, or enabling others to initiate, electronic mail messages."

That isn't the only flaw either. You also need to note this line from CAN-SPAM§7704(B)(1)(A)(i)

".....and such website or online service included, at the time the address was obtained....."

After doing such a large policy change you need to have your users re-accept the Privacy Policy. Because section 3.1 was not there when most users of Menewsha.com signed up, if you were to sell their information to a third party you would be in a heap of legal trouble.




If for some reason you still can't seem to find validity in my arguments then I will go into citing precedence from court cases rather than solely from statutes.

I've been good. My life has flipped in the last few days. Instead of staying in Wisconsin until august and going into BMT fr the Airforce I'll be leaving for California in 2--4 weeks and be going to the Academy of Art San Francisco in August.

That would be my assumption. We may not seem to like each other but personal problems or preference don't take away validity from someone. For the record I don't necessarily dislike him, I dislike his actions and the way he goes about things.

I have a feeling he doesn't want you as part of his staff because you disagree with him too much. Its human nature to push conflict away from yourself.

To be fair, I disagreed with other staff members alot, but I never found it as a hindering quality when I was a staff member. :)

It's been my dream since I was a little girl to be in the air force. One of the people I looked up to as a child was dedicated to his life in the air force. I adopted his way of talking, his morals, even picked up on some of this thinking patterns. Sadly, that dream won't be coming soon in my life time xD;
