Izumi...
He didn't give you proper notices. He didn't give you a chance to pay for the carpet before he replaced it and then demanded you pay. He's trying to frighten you into paying by making you think you have no proof. Well honey, he has no proof either.
Call a free legal aid place and keep calling until you can't anymore. You have enough on your side, I promise. Just be upfront and honest with whomever you speak with, down to the very last detail. Even details you think might make you look bad, say it all.
Let me know how it goes.

One thing that makes me worry though is Aaron didn't leave a forwarding address. I hope me contacting him as soon as I received his postcard speaks for something. Also, our phone number was the same too and I still had my cellphone, which I know the manager should of had. It wasn't like I was hiding.
Fingers crossed. I have a good friend of Aaron's who works at the local college, teaching in the IT department, and has a friend who is a lawyer and leads the club there for pursuing lawyers. I'm going to email him some info to pass to him in hopes that maybe him or one of his pupils would be willing to help us work this one out.
Edit (at nearly 3am in the morning... :|): Well it seems like now that Aaron's cat has once again peed on our bed (the only place she eliminates on other than the litter box - where people sleep.) she's going to be posted on Craig's List and Aaron's already giving it a time limit of this Monday and if no one speaks up for her he said he's already made his mind up she's going to the pound. I feel kinda bad as that is his cat and I gave up one of my boys so he could keep her and now she's sorta had the final straw. After peeing all over the kids' beds (which we ended up tearing down and washing the night they got here -- when we noticed the problem...), and then twice in our bed in the same week...it's kinda come to this. Aaron seems to think that it's because of me and the fact she never really ever did warm up to me.
Ugh. Right now I'm just kinda feeling like an emotional mess atm. I think first thing in the morning I'm calling to cancel my driving test and spend the rest of the afternoon trying to get ahold of someone at the legal aid office. I'm simply not going to be able to let this rest until I get my paperwork in order and speak to someone in the know to give me advice.

You contacting as soon as you received the postcard does show something, plus... if he could get a hold of you via a postcard, what's the issue?? Or am I misunderstanding? I just wonder how he couldn't have sent you a letter about the carpet beforehand if he easily got a hold of you via the postcard?
You had your phone number, too. He could have contacted you via the telephone and elected not to. Not your fault; you weren't hiding, and you can state that. You taking immediate action goes very well in your favor, too.
Let me know how today goes and what you find out. I'm also sorry to hear about the kitty, but her peeing everywhere is... well, you know. It makes me curious, wondering if she's doing it to mark her territory because she doesn't like you. xD; Kinda sucks for her though since she sort of just eliminated herself from the house.

Well I tried calling again and went through to voicemail. I've already emailed them and would prefer to converse via email than via voicemail.
I don't know what his cat's problem was, but to be honest I never cared much for her either. She's not a very affectionate cat, and she did come from the ex-wife's house...which has always been a running joke with me since both of us don't get along well. Saying that though, she has her moments where she will talk to me like we're friends or something...like the other day. I don't understand what triggers her...

I want to smack him one too. He's always been a bit of a jerk, to everyone. To be fair, he worked with us when Aaron was going through periods of unemployment, but I figure he only did that because it was much easier than trying to go through the motion of kicking us out and also we never got more than a month behind anyhow I don't think he could ever legally do it. I think you have to default three months before the landlord can legally file to evict you, unless of other circumstances. I saw a clause for 'just cause', but since that isn't out problem I didn't look into it. I mean we left, turned in the keys, and just really want to be left alone. We simply don't have $600 we can shit out for it right now, otherwise Aaron's like I'd just pay him and tell him to fuck off and leave us alone. (He hates fighting anything...seriously) I know I'm taking a risk trying to do this the hard way, but I'm hoping to have this work out in our favor. I honestly believe the carpet was in perfectly fine shape, and he is only looking to drain more money out of us for the upkeep of his apartments.
Also, unfortunately, no word back from the legal aid office. I did email them yesterday afternoon and tried calling a couple times today. I did spend most of it sleeping though as both hubby and I are feeling pretty sick.

I hope you guys feel better soon, Izumi. x_x
It's good you two are fighting it. If you fight back, maybe he'll avoid trying to do this to others in the future. It sucks that you guys are getting a huge brunt of trouble, but I can't help but wonder if he'd chicken out if you really went to court about it.
I'm sorry about the kitty. :( Even if she wasn't overly affectionate, losing a pet is hard. We had budgies that were meaner than shit, and we were still upset to give them up. xD

Thanks Chi! I think we're just going to need some time. I found out work is in the process of changing over my logins to my married name, so for the time being I'm locked out of work. I think that it couldn't have happened at a better time because A.)I'm sick B.)I'm still technically on unemployment and most important C.)I just want to sleep because of A.
Oh which reminds me, I need to call mom and tell her what's going on. I had to call her to get the number for work since they locked me out and I couldn't access that info online, nor did I write it down.

Not sure. Aaron has lost his voice and has been complaining of feeling very achy and said he was running a fever. Me, I just feel achy and lethargic and been coughing a lot. I have been taking antihistamines to keep me dried up though as soon as I felt like I was having some drainage.

Will do, Chi! Nothing new atm. But I will keep you aware of what happens next. =3
Have fun on your trip!
Edit: I finally got through to someone at the Legal Aid office! However, they told me since it is being held in small claims court that I could not have an attorney represent me, nor give me any help. (I told him I was well aware of not being able to bring an attorney with me on the day, but to have someone give me some solid advice as to what to bring, what to leave out, etc would of been a world of help. I've never done one of those things before!) He also did say that it would be truly bizarre, and the judge would think that he was going well out of his way if he did actually bring up a sample of carpet to the hearing as evidence so not to get too worked up over that I guess. He also said getting statements from people, notarized if possible, would help. I've already called up Aaron's mom and she will do that for me and get it notarized at work. I'm going to try and get in touch with mom and ask her to write a statement for me too stating she gave us a steam cleaner and when she came down to visit there was not any signs of damage done to the apartment, and that it smelled lovely.
Our friend who helped us move out already flat out said he wanted nothing to do with it, but he also has a felony from years past on his record and if they do a background check they could pull that up and use it against us. Of course he also said it did smell of cat in there...That's probably because we had yet to get rid of the chair that they were constantly peeing on. I swear, if they urinated anywhere than where they were suppose to it was either on that damned chair or in one of our beds (from Aaron's cat -- she has this thing about peeing on people's beds...god knows why.). I know that Khimari had an accident in the hallway, but that was promptly dealt with and cleaned up, and I steam vacced the hell out of the hallway carpet on a regular basis, as it was an area with lots of traffic. The only other spot on the carpet was in the bedroom, next to the closet, where Luna gave birth to the kittens. Once again, that area was steamvacced to hell and back and was spotless when we left.

Hi there, btw. Hope you're enjoying your Pokemon. I got scribblenauts recently and that has been the game of choice lately. I just have to pry the DS out of my husband's hands. :XP

I'm currently playing Animal Crossing re-again-again-again-again. xD
I soooo absolutely love this game, mostly because I don't die at the first boss. *shot*
I didn't particularly like scribblenauts. Kinda awkward controls, but then again some people are in love with it. So hopefully you enjoy it. 8)

Yah the controls can be frustrating at times, but the game itself makes up for that. We've had so much fun trying to test the system and see what words don't work, how things react to certain things and just doing the whole VS thing where we bring to life two characters and have them duke it out. It's amazing.
Right now I've got another big thing on my plate right now though. Worried about my MIL. She had to take her boyfriend to the hospital as in a drunken stupor he fell and smashed his head on a decorative urn. She just came by to drop off the phone, and I had a quick look at his face and the whole lefthand side of it is all swollen and bruised to hell. I've never seen anything quite like it. Apparently the DR at the Grand Rapids hospital got all excited too because this was the worst case of an eyelid being ripped off without actually puncturing the eyeball. We're not sure if he lost sight in his left eye now... I feel so sorry for the two of them I really do. She doesn't have the heart to leave him as he literally has no one, but at the same time after countless detoxes (at the hospital, and even a couple at home...highly advise against this as alcohol detoxing is pretty harsh on your body) he's still back at it again. The hospital staff even told MIL to keep him on the bottle because if he stops drinking and has seizures it could cause him to rip all the stitches out and have to be ran up to the hospital again.
Just to give you an idea of the severity of his drinking problems...they did a BAC and he had .47....that's literally enough to kill someone.
So yah, while I'm worried about the court hearing in December, a part of me is really worried about my MIL and hoping things work out for them. We've already told her she has a place to stay if she needs it. Her boyfriend, on the otherhand, is not allowed to stay here. It's harsh, but at the same time we don't have the room and to be quite honest hubby is furious right now with her boyfriend bringing his mother down with him.

Not much I can say but I just hope things turn out as well as possible.
Neither of them should be in any of the positions they're in.
